Compensation for breast enlargements, reductions and uplifts
Breast implant surgery is often carried out to address a medical need, for example, where an accident or the diagnosis of breast cancer leads to removal or one or both breasts, or a quantity of breast tissue. Reconstructive surgery using silicone breast implants is used to restore a natural, healthy appearance.
Alternatively, a woman may seek breast implants or augmentation as a result of a physical issue (such as a noticeable difference in size between breasts). Breast implant surgery is used extensively for transgender individuals who are undergoing surgical procedures in order to support gender realignment.
In all cases of breast surgery, you have the right to expect suitable treatment and the medical professionals whom you trust have a duty of care that is enshrined in law. Manufacturers of breast implants are also obliged to produce safe and comfortable augmentation products. Where these standards have not been met in surgical products or procedures you are within your rights to claim compensation.
Breast implants – surgical negligence
In cases where surgery involving breast implants has gone wrong or has been botched due to negligence on the part of the surgeon, there can be a range of potential problems. These include physical issues such as pain. But they also include unsatisfactory appearance or excessive scarring, which can also have an enormously damaging psychological impact. Internal scarring may cause a hardening of one or both of the breasts – a condition called Capsular contracture, which may require further surgery to correct.
Breast implant rupture
The recent PIP breast implant scandal has shown that faulty or poorly manufactured implants can rapture well before their normal 10 – 15 year expected lifespan. In these instances the leakage of silicone gel into the body can cause a medical emergency requiring the immediate surgical removal of the affected implant.
Some implants are filled with saline solution (salt water) which is naturally absorbed by the body. But it is still necessary to undergo further surgery to have the ruptured implant replaced and the original problem corrected again.
